1. Acceptance of terms
These Terms of Service ("Terms") govern your use of 3p-planners.com and any purchase from 3P Planners. 3P Planners is operated by P3P Labs LLC, a limited liability company registered in the State of California, United States, with its registered address at 827 Herald Street, Redlands, CA 92373, United States ("we", "us", "our"). By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
2. Definitions
- "Website" means 3p-planners.com and all its pages.
- "Products" means the downloadable PDF files sold on the Website.
- "Customer" or "you" means any person who uses the Website or buys Products.
- "Order" means a completed purchase of one or more Products.
- "Consumer" means a Customer acting for purposes outside their trade, business or profession.
3. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an Order. If you create an account, you must give accurate details, keep your login secure and tell us promptly about any unauthorised use. You are responsible for activity under your account.
4. Description of products
All Products are digital PDF files delivered by download. We do not sell or ship physical goods or printed copies. Products do not include coaching, consultations, calls, live sessions, video, app access, memberships, subscriptions, editable software files or personalised or custom-made designs. Previews on the Website show the style and layout of each Product. Colours may look different on screen and in print depending on your device and printer.
5. Pricing and currency
Prices are shown in US dollars (USD) or euros (EUR), based on your selection. The numeric amount is the same in both currencies: for example, a price of 100.00 is charged as $100.00 in USD or €100.00 in EUR. We do not convert between currencies. Prices may change at any time, but changes do not affect Orders already placed. If a Product is listed at a clearly wrong price because of an error, we may cancel the Order and refund any amount paid.
6. Taxes
Where required by law, applicable sales tax, VAT or similar taxes are calculated at checkout based on your location and are shown before you pay. You are responsible for any other taxes or duties that apply to you.
7. Payment
Payment is processed by a third-party payment provider. We do not store your full card details. By placing an Order, you confirm you are authorised to use the chosen payment method. An Order is accepted when payment is confirmed.
8. Instant digital delivery
After payment is confirmed, your Products are made available for download immediately on the confirmation page and by email to the address you provided. Please download and save your files promptly. If you cannot access your files, contact us at info@3p-planners.com.
9. Consent to immediate delivery and the EU right of withdrawal
Consumers in the European Union normally have a 14-day right to withdraw from distance contracts. For digital content not supplied on a physical medium, this right ends once delivery begins, if you have given your express prior consent and acknowledged that you lose the right of withdrawal. At checkout you must tick a box confirming that you agree to immediate delivery and that, as an EU Consumer, you lose your right of withdrawal once the download begins. We will confirm this consent in your order confirmation.
10. Licence
When you buy a Product, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, print and use the Product for your own personal, non-commercial use. You may print as many copies as you need for yourself.
You may not:
- share, give away, sell, resell, sublicense or redistribute the files, in whole or in part;
- upload the files to any website, marketplace, shared drive, social network or file-sharing service;
- claim the designs as your own, or remove any copyright notice.
Small business templates (such as invoices, inventory sheets and content calendars) may be used to run your own business. You may not resell, redistribute or offer them as templates, alone or as part of another product.
11. Intellectual property
All Products, designs, text, graphics, logos and other content on the Website are owned by P3P Labs LLC or its licensors and are protected by copyright, trademark and other laws. The name "3P Planners" and the tagline "Plan. Print. Progress." are our brand features. Except for the licence above, no rights are granted to you.
12. Acceptable use
You agree not to misuse the Website. This includes trying to gain unauthorised access, interfering with its operation, scraping content, using automated means to download Products, using stolen payment details or using the Website for any unlawful purpose.
13. Disclaimer of warranties
To the extent permitted by law, the Website and Products are provided "as is" and "as available". We do not guarantee that the Website will be uninterrupted or error-free, or that Products will meet every specific need. Products are planning tools only and are not financial, legal, medical, fitness or other professional advice.
14. Limitation of liability
To the extent permitted by law, P3P Labs LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Website or a Product is limited to the amount you paid for that Product. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.
15. Indemnification
You agree to indemnify and hold harmless P3P Labs LLC and its members, employees and agents from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Products, including any unauthorised sharing or resale.
16. Refunds
Refunds are handled under our Refund Policy, which forms part of these Terms.
17. Changes to products and terms
We may update, improve or withdraw Products at any time. We may also update these Terms. The version shown on the Website at the time of your Order applies to that Order. The "Last updated" date at the top shows when these Terms last changed.
18. Termination
We may suspend or end your access to the Website, and revoke your licence, if you seriously or repeatedly breach these Terms. On termination you must stop using and delete any affected files. Sections that by their nature should survive will continue to apply.
19. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Before starting any formal proceedings, please contact us at info@3p-planners.com so we can try to resolve the issue informally. If we cannot resolve it within 30 days, any dispute will be brought in the state or federal courts located in San Bernardino County, California, and you and we consent to their jurisdiction.
20. Your consumer rights
Nothing in these Terms limits or excludes any mandatory consumer rights you have under the laws of your country of residence. If you are a Consumer in the EU or another country with mandatory consumer protection laws, you may also bring claims in the courts of your home country where that law allows.
21. Severability
If any part of these Terms is found invalid or unenforceable, the rest will remain in full effect.
